Advertising Terms and Conditions
Within these terms and conditions reference to Visit North Yorkshire shall also include ”us” or “we” as the owner of the website. Visit North Yorkshire is a trading style of North Yorkshire Council whose registered office is County Hall, Racecourse Ln, Northallerton DL7 8AD
The Advertiser is also referred to as ‘you’ in relation to the provision of advertising space on the Visit North Yorkshire websites or any print, digital or other advertising or content created by or on behalf of Visit North Yorkshire.
These terms and conditions apply to all Advertisers placing adverts on Visit North Yorkshire websites including events, banner ads, offers, advertorial content, competitions and web listings at Bronze, Silver, Gold and Platinum levels and to all advertisers taking other advertising services including but not limited to print, digital and outdoor display of advertising content.
- North Yorkshire Council are owners of the Visit North Yorkshire websites (“the website”) and shall place advertisements or information about businesses, points of interest and events at the Advertiser’s request, the content of which shall be reasonable to the extent it is deemed fit and appropriate and does not contravene the British Code of Advertising.
- By Advertising with Visit North Yorkshire, the Advertiser is committing that they will abide by, and be subject to the Visit North Yorkshire Quality Charter.
- Visit North Yorkshire have the right to reject any images, or to reject any application for advertising at any time, without assigning a reason. In the event of an application being rejected after payment, a refund will be made.
- The Advertiser shall be responsible for ensuring that the advertisement submitted to Visit North Yorkshire does not contravene any UK legislation British Code of Advertising Practice or applicable European Legislation. By submitting advertising materials, the Advertiser warrants this is so.
- It is the Advertiser’s responsibility to own the copyright on any images, or to ensure that they have appropriate licences from any and all third parties who may be the owner of the respective copyright.
- In addition to the advertiser’s content, images may be used across the websites to illustrate and enhance the content areas relevant to the advertiser’s business. This use may continue after the advertiser ceases to advertise with Visit North Yorkshire. The advertiser may request images be deleted at any time after their advertising concludes.
- Visit North Yorkshire is not responsible for any material provided by a partner or advertiser in breach of copyright or any other intellectual copyright. In the event of such a breach the sole responsibility shall remain with the Advertiser.
- Visit North Yorkshire may use the images supplied in other digital channels such as social media and e-newsletters to illustrate and enhance content relevant to the advertiser’s business.
- Visit North Yorkshire does not commit to credit images to the photographer and cannot fulfil any usage agreements the Advertiser may have in place that require such acknowledgement.
- Advertiser’s property, transparencies etc. are held by Visit North Yorkshire at the Advertiser’s risk and the Advertiser is responsible for insuring against loss or damage.
- Any data or images supplied by the Advertisers may be held on computer files by Visit North Yorkshire and shall be retained for necessary periods in accordance with the relevant Data Protection legislation in force in England and Wales.
- Visit North Yorkshire cannot accept any responsibility for errors in artwork and copy provided by the advertiser.
- If the Advertiser is providing materials for Visit North Yorkshire or their appointed designers to create artwork, errors must be corrected within the given time at the Proof stage. Any amendments after this time will incur a charge.
- All Advertisers are responsible for checking their website entry or advertisement; otherwise it will be assumed that the information is correct. It is the advertiser’s responsibility to notify Visit North Yorkshire of changes to business information. It is the Advertiser’s responsibility to ensure all prices and availability are correct and honoured.
- Website Partnership Packages will last 12 months unless it is specifically agreed otherwise at the time of purchase. After the initial term the Advertiser’s package will automatically renew unless Visit North Yorkshire are notified in writing 30 days in advance of the renewal date.
- Website partnership packages and other advertising services are non-transferable.
- Upon cancellation of Website Partnership Packages or other advertising services no part of the chargeable fee shall be repayable.
- North Yorkshire Council will not be liable for any loss or damage, consequential or otherwise, occasioned by any error in any advertisement published, or failure of an advertisement to appear from any cause whatsoever. Each Advertiser is liable to indemnify North Yorkshire Council against any claim made against them by any third party arising from the breach by the Advertiser of any of these terms and conditions herein on the part of the Advertiser.
- Payment Terms: Strictly 30 days from the date of invoice.
- All prices as per the advertising materials are exclusive of VAT.
- All prices as per the advertising materials are correct at time of going to press. Visit North Yorkshire reserves the right to increase prices without prior notice in response to increases in material and resource costs or other market factors. - Visit North Yorkshire reserves the right to cancel, amend or vary these terms and conditions without notice at any time for any reason, including change in law or circumstances beyond its reasonable control.
- These terms and conditions are governed by English Law and the English Courts shall have exclusive jurisdiction over any dispute arising in connection with them or any agreement which is entered into which are subject to these terms and conditions.
